1. Overview & Agreement to Terms

Welcome to www.jumpflex.com. By accessing or using this website (the "Website"), or purchasing from PFL USA LLC ("Jumpflex", "we", "us" or "our"), you agree to be bound by the following Terms and Conditions (or "Terms") and all other terms, conditions, policies and notices stated here and on our Website, including our Privacy Policy, Shipping Policy, and Return and Refund Policy, all of which are incorporated into these Terms by these references. These Terms govern your access to and use of the Website and the purchase of any Jumpflex products or services. If you do not agree, please do not use the Website or proceed with a purchase.

Jumpflex reserves the right to modify these Terms at any time without notice. Continued use of the Website or the purchase of a product or service after any changes will constitute your agreement to the revised terms.

IF YOU ARE ENTERING INTO THESE TERMS ON BEHALF OF A COMPANY OR OTHER LEGAL ENTITY, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO BIND SUCH ENTITY TO THESE TERMS, IN WHICH CASE THE TERMS "YOU" OR "YOUR" SHALL REFER TO YOU AND SUCH ENTITY. IF YOU DO NOT HAVE SUCH AUTHORITY, OR IF YOU DO NOT AGREE WITH THESE TERMS, YOU MUST NOT ACCEPT THESE TERMS AND YOU MAY NOT USE THE WEBSITE OR PURCHASE A PRODUCT.

PLEASE READ THE DISPUTE RESOLUTION PROVISION BELOW BECAUSE IT REQUIRES YOU TO ARBITRATE CERTAIN DISPUTES AND CLAIMS WITH US AND LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF FROM US.

While our products are meant to be enjoyed by families and children, the use of our Website and the purchase of the products via the Website and all other aspects of the Website are not intended for the use by children. By agreeing to these Terms, you represent that you are at least the age of majority in your jurisdiction.

Any new features, products or services which are added to the current Website or offline shall also be subject to these Terms. You can review the most current version of the Terms at any time on this page.

2. Conditions of Sale; Shipping; Refunds

All prices are listed in US Dollars and exclude sales tax unless stated otherwise. Applicable taxes will be calculated at checkout. By placing an order, you agree that:

  • You are authorised to make the purchase.
  • You accept these Terms in full.
  • You are either the end customer or acting as an authorised agent on the customer's behalf.

Jumpflex reserves the right to decline or cancel any order prior to dispatch.

3. Pricing, Payment & Currency

Payment must be made in full at the time of purchase. Prices are subject to change without notice. In the event of a pricing or product information error, Jumpflex reserves the right to cancel the order and issue a full refund if already charged.

Except as expressly set forth herein, all fees are non-cancellable and non-refundable.

We utilize the Shopify platform and payment processors to process payments. Our relationship with them is contractual in nature, as they are third-party vendors to us, and they are not subject to our control; thus, the relationship is not, and should not be construed as, one of fiduciaries, franchisor-franchisee, agent-principal, employer-employee, partners, joint venturers or the like. You agree that the third-party payment processor is solely responsible for controlling, handling, processing, or fulfilling purchases processed through its systems. You may be subject to additional terms of use and/or privacy policies of the third-party processor when you make purchases through the Website.

We may from time to time offer promotions of our products. Promotions are subject to change at any time, due to stock availability. Promotions provided on the Website or in print material do not constitute a binding agreement. Only promotions valid at the point of purchase can be considered binding. Jumpflex reserves the right to deem a promotion as invalid at any time without providing notice to customers.

4. Assumption of Risk and Responsibility

Risk Warning

USING TRAMPOLINES OR OUTDOOR PLAY EQUIPMENT INVOLVES INHERENT RISK OF INJURY, DISABILITY, OR DEATH. USE AT YOUR OWN RISK.

Jumpflex products are designed strictly for residential outdoor use. Improper use, poor maintenance, or exposure to extreme weather can result in damage or injury. Adult supervision and adherence to safety guidelines is required at all times. Adult assembly of all products is required. Careful adherence to the installation instructions is required to ensure safety for the user. It is the customer's responsibility to check all boxes to confirm that all components are included and in the correct condition before assembly. Instruct children not to use the equipment in a manner other than intended.

Our products are susceptible to environmental conditions and bad weather. Ensure you do not use your product in inclement weather and take proper precautions. Products can move or lift in strong wind conditions and inclement weather. Ensure that the trampoline is sufficiently stable; anchor kits may be suitable anchorage devices. If your product will be unused for any extended period, disassemble it and store it in a dry place. See your product manual for further information.

The US Consumer Product Safety Commission has published the following safety guidelines regarding the use of trampolines. As the owner or user of a trampoline, you should be aware of these guidelines and government recommendations, and abide by them at all times.

Injuries and deaths can be caused by:

  • Colliding with another person on the trampoline
  • Landing improperly while jumping or doing stunts on the trampoline
  • Falling or jumping off of the trampoline
  • Falling on the trampoline springs or frame

Take these steps to help prevent tragic deaths and serious trampoline injuries, especially paralysis, fractures, sprains, and bruises:

  • Allow only one person on the trampoline at a time.
  • Do not attempt or allow somersaults, because landing on the head or neck can cause paralysis.
  • Do not use the trampoline without shock-absorbing pads that completely cover its springs, hooks and frame.
  • Place the trampoline away from structures, trees and other play areas.
  • No child under 6 years of age should use a full-size trampoline.
  • Always supervise children who use a trampoline.
  • Trampoline enclosures can help prevent injuries from falls off trampolines.

Additional safety guidelines are as follows:

  • Use trampoline only with mature, knowledgeable, adult supervision.
  • Inspect before use. Keep frame padding in place.
  • Climb on and off the trampoline. Do not use the trampoline as a springboard.
  • The trampoline ladder must be removed and stored in a secure location whenever the trampoline is not in use. The ladder should only be attached when a responsible adult is present to supervise jumping. Never leave the ladder attached while the trampoline is unattended, because it provides unsupervised access by small children.
  • Stop bounce by flexing knees as feet come in contact with the bed.
  • Learn fundamental bounces and body positions thoroughly.
  • Avoid bouncing too high. Maintain control.
  • While keeping the head erect, focus eyes on the trampoline toward the perimeter.
  • Bounce in the center of the bed.
  • Avoid bouncing when tired.
  • Secure the trampoline against unauthorized use.
  • Keep objects away which could interfere with the performer.
  • Do not use the trampoline while under the influence of alcohol or drugs.
  • For equipment information, contact the manufacturer.
  • For skill training information, contact a trainer certification organization.
  • Do not use when trampoline is wet or in windy conditions.
  • Read instructions and manuals before use.

5. Disclaimers and Limitation of Liability

5.1 Product Disclaimers

BY PURCHASING AND USING ANY PRODUCT FROM JUMPFLEX, YOU ACKNOWLEDGE THAT THERE ARE INHERENT RISKS ASSOCIATED WITH THE USE OF OUR PRODUCTS, INCLUDING BUT NOT LIMITED TO PRODUCT MALFUNCTION, IMPROPER USE, DEFECTIVE ASSEMBLY, ENVIRONMENTAL HAZARDS, PERSONAL INJURY AND DEATH. YOU FURTHER CONFIRM THAT YOU HAVE READ AND UNDERSTOOD ALL SAFETY INSTRUCTIONS PROVIDED AND AGREE TO FOLLOW THEM TO MINIMIZE RISKS.

TO THE FULLEST EXTENT PERMITTED BY LAW:

  • JUMPFLEX AND ITS SUBSIDIARIES, AFFILIATES, AND EACH OF ITS AND THEIR RESPECTIVE EMPLOYEES, DIRECTORS, OFFICERS, SHAREHOLDERS, AGENTS, VENDORS, LICENSORS, CONTRACTORS, SUCCESSORS AND ASSIGNS (COLLECTIVELY, THE "JUMPFLEX PARTIES") ARE NOT LIABLE FOR PROPERTY DAMAGE, PERSONAL INJURY, OR DEATH DUE TO MISUSE, INCORRECT INSTALLATION, OR ENVIRONMENTAL CONDITIONS.
  • THE JUMPFLEX PARTIES SHALL HAVE NO LIABILITY FOR PERSONAL INJURY OR DEATH BECAUSE THE PRODUCT WAS NOT: (I) INSTALLED IN ACCORDANCE WITH THE JUMPFLEX INSTRUCTION MANUAL; (II) INSTALLED WITH DUE CARE AND SKILL, BY THE CUSTOMER OR A THIRD PARTY ASSEMBLY SERVICE; OR (III) IN THE SAME CONDITION AS WHEN THE PRODUCT WAS SUPPLIED, DUE TO WEAR AND TEAR – INCLUDING, BUT NOT LIMITED TO, WEATHER DAMAGE, DETERIORATION OF THE NET, SPRING STRETCH, UV DETERIORATION OR RUST.
  • THE CUSTOMER ASSUMES AND ACCEPTS ALL SUCH RISKS ASSOCIATED WITH THE USE OF OUR PRODUCTS, AND TO THE FULL EXTENT PERMITTED BY LAW HEREBY WAIVES THE RIGHT OF ACTION AGAINST, AND FULLY RELEASES THE JUMPFLEX PARTIES FOR, LOSS, DAMAGES, PERSONAL INJURY OR DEATH IN ANY WAY CAUSED BY, OR RELATING TO, THE CUSTOMER'S USE OF OUR PRODUCTS. THIS INCLUDES, WITHOUT LIMITATION, LIABILITY FOR ANY NEGLIGENT OR TORTUOUS ACTS OR OMISSION, BREACH OF DUTY, BREACH OF CONTRACT OR BREACH OF STATUTORY DUTY ON THE PART OF THE JUMPFLEX PARTIES.

5.2 Website Disclaimers

We use commercially reasonable efforts to display accurate colors and images of our products that appear on the Website. We cannot guarantee that your computer monitor's display of any color will be accurate.

Occasionally there may be information on the Website that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information on the Website or on any related website is inaccurate at any time without prior notice (including after you have submitted your order). We undertake no obligation to update, amend or clarify information on the Website or on any related website, including without limitation, pricing information, except as required by law.

THE WEBSITE IS PROVIDED "AS IS, AS AVAILABLE" AND "WITH ALL FAULTS." JUMPFLEX AND ITS SUPPLIERS AND LICENSORS MAKE NO REPRESENTATION, WARRANTY, OR GUARANTY AS TO THE RELIABILITY, TIMELINESS, QUALITY, SUITABILITY, TRUTH, AVAILABILITY, ACCURACY OR COMPLETENESS OF THE WEBSITE. JUMPFLEX AND ITS SUPPLIERS AND LICENSORS DO NOT REPRESENT OR WARRANT THAT (i) THE USE OF THE WEBSITE WILL BE SECURE, TIMELY, UNINTERRUPTED OR ERROR-FREE OR OPERATE IN COMBINATION WITH ANY OTHER HARDWARE, SOFTWARE, SYSTEM OR DATA, (ii) THE WEBSITE WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS, OR (iii) THE WEBSITE OR THE SERVER(S) THAT MAKE THE WEBSITE AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. 5.3 Waiver

BY USING THE WEBSITE AND PURCHASING OUR PRODUCTS, YOU UNDERSTAND THAT YOU MAY BE WAIVING RIGHTS WITH RESPECT TO CLAIMS THAT ARE AT THIS TIME UNKNOWN OR UNSUSPECTED. ACCORDINGLY, YOU AGREE TO WAIVE THE BENEFIT OF ANY LAW, INCLUDING, TO THE EXTENT APPLICABLE, CALIFORNIA CIVIL CODE SECTION 1542, THAT OTHERWISE MIGHT LIMIT YOUR WAIVER OF SUCH CLAIMS.

5.4 General Warranty Disclaimers

THE EXCLUSIVE WARRANTIES OF OUR PRODUCTS ARE AS SET FORTH IN OUR WARRANTY PROGRAM DESCRIBED IN SECTION 7 AND OUR RETURN AND REFUND POLICY.

EXCEPT AS SET FORTH IN SECTIONS 7 AND THE RETURN AND REFUND POLICY, ALL CONDITIONS, REPRESENTATIONS AND WARRANTIES REGARDING OUR WEBSITE, PRODUCTS AND SERVICES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT OF THIRD-PARTY RIGHTS, ARE HEREBY DISCLAIMED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW BY THE JUMPFLEX PARTIES.

5.5 Limitations of Liability

EXCEPT WHERE PROHIBITED BY LAW, IN NO EVENT AND UNDER NO LEGAL THEORY WILL THE JUMPFLEX PARTIES BE LIABLE TO YOU OR YOUR DEPENDENTS, PERSONAL REPRESENTATIVES, HEIRS OR SUCCESSORS FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL OR PUNITIVE DAMAGES, EVEN IF THE JUMPFLEX PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSSES OR DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE JUMPFLEX PARTIES' AGGREGATE LIABILITY TO YOU FOR ANY DAMAGES (DIRECT OR OTHERWISE) OR PENALTIES OR LOSS, REGARDLESS OF THE FORM OF ACTION OR CLAIM, EXCEED THE AMOUNTS PAID BY YOU TO JUMPFLEX IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.

THE LIMITATIONS AND EXCLUSIONS SET FORTH IN THE FOREGOING PARAGRAPHS OF THIS SECTION 5 APPLY REGARDLESS OF WHETHER THE LIABILITY IS BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, BREACH OF WARRANTIES, OR ANY OTHER LEGAL THEORY, AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations in this Section may not apply to you.

6. Indemnity

You agree to indemnify and hold the Jumpflex Parties harmless from any demands, loss, liability, claims due to or arising out of or in connection with (1) your access to or use of the Website or our products in violation of these Terms; (2) your violation of these Terms or any applicable law, rule or regulation, (3) your violation of any rights of any third party; or (4) any disputes or issues between you and any third party. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will assist and cooperate with Jumpflex in asserting any available defenses.

7. Warranty

7.1 Warranty Coverage

This warranty covers manufacturing faults and defects only. Warranty periods begin from the date the product is shipped to the customer. Note: Replacing a part (or multiple thereof) does not reset or extend the original warranty period of the product.

If a customer believes that a Jumpflex product is faulty or defective, they must discontinue use and submit a Warranty Claim.

A customer must not attempt to use a product if any part is faulty or defective. Any damage that the user causes as a result of using faulty or defective products will lead to voiding of the warranty.

Any replacement part under Warranty will be, in our discretion, either a replacement of the original part or the provision of a new part for the same functionality. As an example, some of our products utilize a zipper rather than a flap on the nets. If you have a warranty claim for a net that has a flap, you may receive either a net that has a flap (original) or a net that has a zipper (new part).

7.2 Warranty Exclusions

The warranty does not cover:

(i) Wear and Tear

  • Surface rust smaller than ¾ inch (2 cm)
  • Holes or tears in the Jump Mat smaller than ¾ inch (2 cm)
  • Fading, stretching, or deterioration of materials over time
  • UV damage or fabric disintegration due to sun exposure

(ii) Weather and Environmental Conditions

  • Damage caused by wind, storms, snow, or sun exposure
  • Snow load, ice build-up, or extreme temperatures affecting product lifespan. It is strongly recommended to disassemble your trampoline mat, net enclosure and product shade cover and store indoors; checking that the mat, padding and enclosure and shade cover are without defects. Ensure to remove any snow from the products and the shade cover.
  • Exposure to ocean spray or assembly within 1 mile (1.6 km) of a saltwater environment — in such cases, warranty on steel parts may be reduced by 50%
  • Note: Sunlight, rain, snow and extreme temperatures reduce the strength of components over time.

(iii) Improper Installation

  • Any issues resulting from incorrect assembly or not following the official Jumpflex Assembly Manual
  • Damage or failure due to missing components not reported before installation
  • Use of third-party assembly services not authorised by Jumpflex

(iv) Insufficient Maintenance

  • Premature wear due to lack of regular inspection, cleaning, or following care instructions
  • Damage from mold, rust, or build-up due to improper storage or use

(v) Misuse or Inappropriate Use

  • Using the trampoline for gymnastic, stunt, or commercial purposes
  • Attaching third-party accessories or unauthorised modifications
  • Exceeding maximum user weight or allowing multiple users in ways not outlined in the safety guidelines

(vi) Commercial Use

  • Jumpflex products are designed for residential/domestic use only
  • Any use in schools, rental properties, parks, gyms, or play centers will void the warranty

(vii) Personal Injury or Incidental Loss

  • Product misuse
  • Improper assembly
  • Failure to follow safety and maintenance guidelines
  • Negligence or accidents

(viii) Other

  • This warranty does not cover any installation service. If a customer pays for installation of their trampoline or swing set at the time of purchase, this is a one-time service only. The customer may not claim installation costs for any replacement parts under any circumstances.

Making a Warranty Claim

  • Contact Jumpflex Customer Support or submit via the website
  • Provide your order number and photos showing the suspected issue
  • Jumpflex will assess the claim and determine whether to repair, replace, or offer an alternative solution
  • Replacement parts may be new or refurbished and do not extend the original warranty period

Jumpflex endeavours to resolve all warranty claims as quickly as possible, however, we cannot be held responsible for any delays in the processing of your warranty claim.

8. Order Cancellation

  • Orders may be cancelled upon request only if they have not yet entered the dispatch process.
  • Handling or restocking fees may apply.
  • Once an order has begun the dispatch process (including picking, packing, or labeling), it is considered "Dispatched" and cannot be cancelled. In these cases, please refer to our Return and Refund Policy.
  • Dispatched orders must follow the Return and Refund Policy.

9. Privacy Policy

Please see our Privacy Policy for information on how we collect, use and disclose information from our users and customers. Additionally, by using the Website, you acknowledge and agree that Internet transmissions are never completely private or secure. You understand that transmissions to or through the Website may be intercepted by others, and users assume the risk of security breaches and all consequences resulting from them. You agree to immediately notify us of any breach of security that you become aware of involving or relating to your use of the Website by emailing hello@jumpflex.com.

10. Intellectual Property; Acceptable Use

10.1 Jumpflex reserves all rights, title, and interest in and to the Website and our products including all related intellectual property rights. Unless otherwise noted, the Website and all text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, artwork and computer code on the Website (collectively, "Content"), including but not limited to the design, structure, selection, coordination, expression, "look and feel" and arrangement of such Content, contained on the Website is owned, controlled or licensed by or to Jumpflex and is protected by trade dress, copyright, patent and trademark laws, and various other intellectual property rights. Except as expressly provided in these Terms, no part of the Website and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way to any other computer, server, website or other medium for publication or distribution or for any commercial enterprise, without our express prior written consent.

10.2 You acknowledge and agree that any submission, feedback, reviews, comments or suggestions you may provide regarding the Website or our products either directly or indirectly (for example, through the use on a third-party social media site of a company-designated hashtag) (collectively, "Submissions") is non-confidential and non-proprietary, shall be treated as public information, may be shared with others on other sites and platforms and is submitted by you in compliance with these Terms. Submissions that constitute feedback, comments or suggestions (collectively, "Feedback") will be the sole and exclusive property of Jumpflex, and you hereby irrevocably assign to us all of your right, title and interest in and to all such Feedback, and Jumpflex shall have an unrestricted, irrevocable, world-wide, royalty-free right to use, communicate, reproduce, publish, display, distribute and exploit such Feedback in any manner it chooses. With respect to all other non-Feedback Submissions, including without limitation photos, you hereby grant Jumpflex an irrevocable, worldwide and perpetual license to use such Submissions as contemplated in these Terms.

10.3 You may not create, post, store or share any Submissions that violate these Terms or for which you do not have all the rights necessary to grant us the license described above. You represent and warrant that your Submissions, and our use of such content as permitted by these Terms, will not violate any rights of, or cause injury to, any person or entity. Notwithstanding the generality of the foregoing, you must have consent of all individuals who appear in any videos or photographs that you submit to the Website, or if such individuals are children, that you have the consent of such child's parent or legal guardian. Although we have no obligation to screen, edit or monitor Submissions, we may delete or remove Submissions at any time and for any reason with or without notice.

10.4 Reference to any third party-owned trademarks herein is for informational purposes only and is not intended to indicate or imply any affiliation, association, sponsorship or endorsement by any owners of such third party-owned trademarks.

10.5 In connection with your use of the Website, you agree that you will not:

  • post, upload, publish, submit or transmit any material that: (a) infringes, misappropriates or violates a third party's patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or rights of publicity or privacy; (b) violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability; (c) is fraudulent, false, misleading or deceptive; (d) is defamatory, obscene, pornographic, vulgar or offensive (as determined in our sole discretion); (e) promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group; (f) is violent or threatening or promotes violence or actions that are threatening to any other person; or (g) promotes illegal or harmful activities or substances;
  • interfere with or damage the Website, including, without limitation, through the use of viruses, cancel bots, Trojan horses, harmful code, flood pings, denial-of-service attacks, packet or IP spoofing, forged routing or electronic mail address information or similar methods or technology;
  • violate any local, state, provincial, national, or other law or regulation, or any order of a court;
  • "scrape," "crawl" or "spider" any web pages or other services contained on the Website;
  • display, mirror or frame the Website, or any individual element within the Website, Jumpflex's name, any Jumpflex trademark, logo or other proprietary information, or the layout and design of any page or form contained on a page, without Jumpflex's express written consent;
  • access, tamper with, or use non-public areas of the Website, Jumpflex's computer systems, or the technical delivery systems of Jumpflex's providers;
  • attempt to probe, scan, or test the vulnerability of any Jumpflex system or network or breach any security or authentication measures;
  • attempt to decipher, decompile, disassemble or reverse engineer any of the software used to provide the Website; or
  • advocate, encourage, or assist any third party in doing any of the foregoing.

13. Dispute Resolution

PLEASE READ THE FOLLOWING SECTION CAREFULLY BECAUSE IT REQUIRES YOU TO ARBITRATE CERTAIN DISPUTES AND CLAIMS WITH JUMPFLEX AND LIMITS THE MANNER IN WHICH YOU CAN SEEK RELIEF FROM US.

Binding Arbitration. You agree that to the fullest extent permitted by law all disputes, claims, suits, or controversies arising out of or in any way connected with these Terms and the use of the Website and our products and services (collectively, "Disputes"), shall be finally settled by binding arbitration administered by the American Arbitration Association ("AAA") under the Commercial Dispute Resolution Procedures and the Supplementary Procedures for Consumer Related Disputes (collectively, "AAA Rules") of the AAA, as modified by these Terms. There shall be one arbitrator appointed in accordance with the Rules, and you waive your rights to have any and all Disputes resolved in a court; provided, however, that this agreement to arbitrate does not extend to Disputes in which either party seeks (i) injunctive or other equitable relief for the alleged unlawful use of intellectual property, including, without limitation, copyrights, trademarks, trade names, logos, trade secrets or patents, (ii) the right to pursue enforcement actions through applicable U.S. federal, state, or local agencies where such actions are available, or (iii) injunctive relief in a U.S. court of law. The arbitration proceedings and decision of the arbitrator shall be kept confidential (and may not be disclosed) by the parties or the arbitrator, except to the extent necessary to compel any award made by the arbitrator.

No Class Arbitrations, Class Actions or Representative Actions. Any Dispute will be resolved solely through individual arbitration and will not be brought as a class arbitration, class action or any other type of representative proceeding. There will be no class arbitration or arbitration in which an individual attempts to resolve a Dispute as a representative of another individual or group of individuals. Further, a Dispute cannot be brought as a class or other type of representative action, whether within or outside of arbitration, or on behalf of any other individual or group of individuals.

Location. The location of the arbitration shall be in Wilmington, Delaware.

Authority of Arbitrator. As limited by the AAA Rules and these Terms, the arbitrator will have (i) the exclusive authority and jurisdiction to make all procedural and substantive decisions regarding a Dispute, including the determination of whether a Dispute is arbitrable, and (ii) the authority to grant any remedy that would otherwise be available in court; provided, however, that the arbitrator does not have the authority to conduct a class arbitration or a representative action, which is prohibited by these Terms, or to award punitive damages or any other damages that are not compensatory. The arbitrator may only conduct an individual arbitration and may not consolidate more than one individual's claims, preside over any type of class or representative proceeding or preside over any proceeding involving more than one individual.

Jurisdiction. To the extent that any lawsuit or court proceeding is permitted under these Terms, to the fullest extent permitted by law you agree to submit to the personal and exclusive jurisdiction of the state courts and federal courts located in Wilmington, Delaware for the purpose of litigating all such disputes. You also waive your rights to a jury trial.

Time Limit for Claims. Any claim under these Terms must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred. You agree to the admissibility of computer records and electronic evidence in any dispute herein.

Severability of Dispute Resolution; Arbitration. In the event the provisions in this Dispute Resolution Section are held invalid or unenforceable, then this Dispute Resolution Section, in its entirety, will cease to apply, and the parties will not be obligated to arbitrate any Disputes.
